Eligibility Criteria EB-2 NIW

EB2-NIW로 영주권을 받아 미국에 살고 있지만 처음 이 얘기를 들었을 때는 다른사람들의 이야기로만 생각했다.

무언가 굉장한 실적과 학력, 경력이 있고 미국과 어떤 관계가 있어야 하는 것으로 생각했기 때문이다.

보잘것없는 나에게 이런게 해당될리 없다고 여기고 시작했고 가능하더라도 꽤 시간이 걸릴것으로 예상했다.

USCIS의 관련 내용을 보고서도 쉽게 자신감을 가지긴 어려웠었다.

지금은 이런 생각을 하지 않지만 당시에는 그랬다.

여기에 보면 Eligibility criteria가 잘 정리되어있다.

NIW는 EB-2의 sub-category 중 하나이다.

- Advaned degree

- Exceptional ability

- National Interest Waiver (NIW)

 

각 sub-category의 description과 그에 대한 evidence가 정의되어 있으나 관심은 NIW이니 NIW만...

 

NIW는 aliens seeking a national interest waiver are requesting that the Labor Certification be waived because it is in the interest of the United States.

Though the jobs that qualify for a national interest waiver are not defined by statute, national interest waivers are usually granted to those who have exceptional ability and whose employment in the United States would greathly benefit the nation.

Those seeking a national interest waiver may sefl-petition (they do not need an employer to sponsor them) and may file their labor certification directly with USCIS along with therir Form I-140, perition for alien worker.

 

명확하게 명시되지 않고 에메하다...

주요한 심사의 기준이 명확히 정의되지 않았으나 기본적으로는 Advanced degredd와 exceptional ability를 가지고 있어야 한다 (즉 기본적인 EB2 category의 조건을 만족해야 한다).

그리고 그것이 미국의 국가적인 이익을 가져올 수 있는지가 주요한 포인트이다.

이에 대한 evidence로 적어도 아래 3가지 이상의 criteria를 만족해야하고 그에 대한 증빙을 해야한다고 나와있다.

* Criteria

- Official academic record showing that you have a degree, diploma, certificate, or siliar award form a college, university, school, or other institution of learning relating to your area of exceptional ability

- Letters documenting at least 10 years of full-time experience in your occupation

- A license to practice your profession or cerfitication for your profession or occupation- Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability

- Membership in a professional association

- Recognition for your achienements and significant contributions to your industry or field by your peers, government entities, professional or business organizations

- Other comparable evidence of eligibility is alos acceptable

대략 몇가지는 증빙할 수 있을 것 같아 보이지만 어렵다.

 

여기에 Dhanasar lay라는 3가지 조건을 충족하여야 한다.

1. The waiver applicant's proposed endeavor must have both substantial merit and national importance 

2. The waiver applicant must demonstrate that they are well positioned to advanced the proposed endeavor

3. The waiver applicant must demonstrate that it would be beneficial to the United States to waive the job offer and labor certification requirements

 

노동 승인 면제를 위한 조건을 반드시 만족시켜야 함을 명시하고 있다.

이렇기 때문에 내 분야가 이를 충족시킬 수 있는지 사전에 명확히 적용시켜야 한다.

내 분야는 flow/fluid control 인데 이게 미국익에 기여할 수 있는것인지를 먼저 check했었다.어찌보면 내 학력과 직장 경력은 명확하게 미국의 국익과 공공 발전에 기여할 수 있는 것이었다.

Oil & gas, power generation은 국가 기간 산업이며 공공설비들로 국민들의 생활에 밀접히 관련되어 있기 때문이다.

연구와 개발업무 자체도 미국과 연계되어 많이 진행했었기 때문에 비교적 쉽게 미국에 기여할 수 있는 부분을 찾을 수 있었다.

NIW를 하면서 다시한번 지금까지 했던 일들을 돌아볼 수 있었고 공부할 수 있었던 계기가 되었다.

심사기준, 확률, 다른 이들의 사례 같은 것은 참고가 될 수 있지만 절대적으로 내 케이스에 적용되지는 않는다. 

내 케이스에 집중하고 나의 과거, 현재, 미래의 연결고리를 잘 꿰고 국익에 기여할 수 있는 분야를 잘 잡아가면서 그에 대한 객관적인 실적을 증빙하는 것이 중요함을 느꼇다.

NIW는 다른 취업이민 카테고리에서 필수로 필요한 노동인증 (회사가 있어야하고 그 회사의 스폰서를 받아야함)이 필요없다는 장점이 있지만 이 waiver를 받을 자격이 된다는 것을 명확하게 보여야하는 어려움이있다.

결과적으로는 영주권을 받았지만 결코 쉽지 않으며 엄청난 노력과 준비를 해야한다.

서류하나하나 신중하고 정확해야하며 본인 확인과 검증이 필수이며 모든 과정에 자신이 개입하고 다 만져야 한다 (일부 전문 변호사의 도움이 필요하지만 어디까지나 도움에 한정된다).

특히 미국에서 신분문제만큼은 그러하다....
